OFFICIAL CONTEST RULES

  1. ELIGIBILITY: To be eligible, you must be an individual resident of Canada and have reached the age of majority in the province/territory in which you reside. You are not eligible if you are: a) an agent or dealer of Yamaha Motor Canada Ltd.; b) an; employee of Yamaha Motor Canada Ltd. (“Sponsor”), or its respective affiliates, dealers or its advertising or promotional agencies; or c) a member of the immediate family or household of any of the above persons.  In these rules, “immediate family” means spouse, father, mother, brothers, sisters, sons, daughters.


  2. HOW TO ENTER: NO PURCHASE NECESSARY. The Sponsor will run a series of eight (8) Monthly Prize Trail Contests. One contest will be held each month from May 2006 until December 2006. Entry forms are located online only at www.yamaha-motor.ca.  To enter the contest Log in to your My Yamaha account and answer the Monthly Prize Trail question and submit your response online.

    Entries for each contest must be submitted no earlier than 12:00 a.m. ET on the first day of the month in which the contest is held, and no later than 11:59 p.m. ET on the last day of that same month.  For example, to be eligible for the May 2006 contest prize, your entry must be submitted between 12:00 a.m. ET on May 1, 2006 and 11:59 p.m. ET on May 31, 2006, with the prize winner being selected on the first business day of June, 2006.

    Limit: Only one entry per person can be made per contest. The first entry submitted by a person will be considered official.  All other subsequent entries in the same contest by that person will be disqualified. The Sponsor is not responsible for illegible entries, incomplete, lost, misdirected or late entries, which will be void. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. A person’s entry in one contest does not constitute contest entry in the following contests.

  3. PRIZES: The prize to be awarded for the September 2010 Monthly Prize Trail contest is an with a retail value of . See www.yamaha-motor.ca to view the prize to be awarded for this month’s contest.

    The contest prize will be delivered to the winner’s home address within thirty (30) days of the draw.  The contest prize is not transferable and must be accepted as awarded with no substitutions in cash or otherwise, except at the Sponsor's sole discretion. The Sponsor reserves the right to substitute the prize with a prize of equivalent value if the prize cannot be awarded as described.  The prize will only be delivered to the successful entrant.

  4. DRAWING: For each contest, one prize winner will be selected from all the eligible entries relating to that contest. A random drawing will be conducted by an employee of the Sponsor from the total eligible entries for each contest. The contest draw will take place on the first business day of the month following the contest at 11:00 am ET at Yamaha Motor Canada Ltd., 480 Gordon Baker Rd. Toronto, Ontario. The first entry drawn having the correct response to the contest’s skill testing question will be the winner of the prize as described above in Section 3. The winner will be notified by e-mail within two days following the drawing. If the winner cannot be contacted by e-mail within 5 business days, the prize will be forfeited and awarded to the next entrant selected who correctly answered the contest’s question. Odds of winning for each contest will depend on the total number of entrants.


  5. RELEASES, ETC.:  A winner may be required to sign a Declaration of Compliance (“Declaration”) with these rules and a Release of Liability form (“Release”), releasing the Sponsor and its affiliates, advertising or promotional agencies, and all of their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any liability in connection with or arising out of this contest or any prize.  Should the Declaration and Release documents be required, the Sponsor must receive them prior to the prize being delivered. 

    By accepting the prize, the winner consents to the use of his/her name, place of residence, voice, statements and photograph or other likenesses for publicity, advertising or informational purposes, in any medium or format (including the Internet) without further compensation or notice.
    By entering this contest the participant agrees to hold harmless the Releasees from and against any and all liability, damages or causes of action (however named or described) with respect to or arising out of the participant’s receipt or use of the prize awarded herein.  Participant hereby releases, waives and discharges any and all claims of damages or causes of action, including but not limited to, death, which the participant or the participant’s representatives, heirs, next of kin, or assignees (“Participant’s Representatives”) may hereinafter accrue to the participant or the Participant’s Representatives as a result of the participant’s participation in the contest or the receipt or use of the prize awarded therein, or which may be asserted by the participant or the Participant’s Representatives against the Releasees.

  6. LIMITATIONS OF LIABILITY: Without limiting the release provided in Section 5 above, and for greater certainty, The Releasees will not be liable for: a) any incomplete or inaccurate information, whether caused by contest Web site users or by any equipment or programming associated with or utilized in the contest, or by any technical or human error which may occur in the processing of entries; b) the theft, destruction or unauthorized access to, or alteration of, entries; c) any problems with, or technical malfunctions of, telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses, bugs; d) any failure of any e-mail to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof; or e) damage to a participant's or other person's system occasioned by participation or downloading of materials in this contest.


  7. MISCELLANEOUS: Participants who have not complied with these Official Contest Rules are subject to disqualification. All decisions of the Sponsor are final and binding in all matters relating to this contest. No correspondence will be entered into except with selected participants. The contest is subject to all applicable federal, provincial and municipal laws.  Limit: one prize per person per contest. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. Sponsor reserves the right at their sole discretion to disqualify any individual that they find or believe to be tampering with the entry process or the operation of the contest or contest website; to be acting in violation of the Official Contest Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST COULD BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.


  8. RESIDENT OF QUEBEC:  With respect to Quebec residents and to entries originating within the Province of Quebec:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des Courses et des Jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.


  9. PRIVACY All information about an entrant collected will be handled in accordance with the Sponsor’s Privacy Policy and will only be used for the purposes of the contest and for no other purpose unless the entrants consent is first obtained.
